All reservations made through this website are subject to availability and confirmation by The Whaler’s Inn. Room rates, packages, promotions, and special offers are subject to change without notice and may be subject to additional terms and conditions disclosed during the reservation process. The Whaler’s Inn reserves the right to correct pricing errors and to cancel or modify reservations that result from such errors. To make a reservation or check into the property, guests must be at least eighteen (18) years of age and present a valid government-issued photo identification and a valid credit card at the time of check-in. The Whaler’s Inn reserves the right to refuse accommodations to any individual who does not meet these eligibility requirements.

Cancellation policies may vary based on the season, dates of stay, room type, package selected, promotional offer, or rate plan booked. Certain reservations may be fully refundable if canceled within the specified cancellation window, while others may require a deposit, be subject to cancellation fees, or be entirely non-refundable.

Guests are responsible for reviewing and understanding the specific cancellation policy associated with their reservation at the time of booking. The most current and applicable cancellation terms will be provided during the reservation process and included in the reservation confirmation sent to the email address provided at the time of booking.

By submitting payment information through the website, you represent and warrant that you are authorized to use the payment method provided. The Whaler’s Inn may require deposits, pre-authorizations, or full payment at the time of booking, depending on the rate plan selected. Applicable taxes, fees, and incidental charges will be charged in accordance with the reservation terms and applicable law.

Guests staying at The Whaler’s Inn are expected to comply with all property policies and conduct themselves in a respectful and lawful manner. Guests are responsible for any damage caused to guest rooms, furnishings, fixtures, equipment, or other property during their stay, including but not limited to excessive cleaning requirements, smoking violations, missing items, or damage resulting from negligence or misconduct.

Following a guest’s departure, The Whaler’s Inn reserves the right to inspect all accommodations and property areas used by the guest. If damage, excessive cleaning, missing property, policy violations, or other chargeable incidents are discovered, The Whaler’s Inn will conduct a full evaluation of the incident and associated costs. The guest will be notified in writing at the email address provided during the reservation process within 24 to 48 housra and will receive an itemized summary of the charges, supporting documentation when applicable, and an opportunity to respond.

Guests will have 3 to 7 business days from the time the notification is sent to dispute the charges, provide additional information, or request further clarification. If no response is received within the forty-eight (48) hour period, The Whaler’s Inn reserves the right to charge the payment method on file for the documented costs incurred. The Whaler’s Inn will review all disputes in good faith and reserves the right to make the final determination based on the evidence available, including photographs, inspection reports, vendor invoices, staff statements, and other relevant documentation.

The website and its contents, including but not limited to text, images, graphics, logos, designs, videos, software, and trademarks, are the property of The Whaler’s Inn or its licensors and are protected by applicable intellectual property laws. No material from this website may be copied, reproduced, distributed, transmitted, displayed, or otherwise used without the prior written consent of The Whaler’s Inn.

From time to time, the website may contain links to third-party websites or services for the convenience of our guests. The Whaler’s Inn does not control and is not responsible for the content, privacy practices, security, or availability of any third-party website. Access to such websites is undertaken at the user’s own risk.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by The Whaler’s Inn’s negligence, fraud or fraudulent misrepresentation, gross negligence, willful or intentional misconduct, or any other liability that cannot be excluded or limited under applicable law. In jurisdictions where limitations of liability are restricted, The Whaler’s Inn’s liability shall be limited to the maximum extent permitted by law.

Except as expressly prohibited by law, the aggregate liability of The Whaler’s Inn arising from any claim, dispute, or cause of action shall not exceed the total amount paid by the guest to The Whaler’s Inn for the reservation or services giving rise to the claim.
The Whaler’s Inn shall not be responsible for any delay, interruption, cancellation, or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, severe weather events, natural disasters, public health emergencies, labor disputes, government actions, utility failures, internet outages, or other force majeure events.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles.

In the event of any dispute, claim, or controversy arising out of or relating to the use of this website, a reservation, a guest stay, services provided by The Whaler’s Inn, or these Terms and Conditions, the parties agree to first attempt to resolve the matter through good-faith informal discussions. Any party seeking to raise a dispute must provide written notice describing the nature of the claim and the relief sought. The parties shall have thirty (30) days from receipt of such notice to attempt to resolve the dispute informally.

If the dispute cannot be resolved through informal discussions, the parties agree to participate in non-binding mediation in Connecticut before commencing litigation, unless immediate legal action is necessary to protect a party’s legal rights or prevent irreparable harm.

Should mediation fail to resolve the dispute, or if a party declines to participate in mediation, either party may pursue available legal remedies. Any lawsuit arising out of or relating to these Terms and Conditions, the use of this website, a reservation, or services provided by The Whaler’s Inn shall be brought exclusively in the state or federal courts located within the State of Connecticut, and the parties hereby consent to the personal jurisdiction and venue of such courts.

Nothing in this provision shall prevent The Whaler’s Inn from seeking immediate injunctive or equitable relief where necessary to protect its property, confidential information, intellectual property rights, safety, or business operations.
 
The Whaler’s Inn reserves the right to amend or update these Terms and Conditions at any time. Any changes will become effective immediately upon posting to the website. Continued use of the website following the posting of revised Terms constitutes acceptance of those changes.
